My mother married in 1958. In 1960, her husband married again, right in front of her! She endured this humiliation and domestic abuse from his family, and left with her two-year-old daughter to live with my grandfather. She raised me and got me married, all while working on the farm every day. My father never gave her a single rupee. Now she’s over 70, and I’m over 50. Three years ago, she filed for maintenance, but hasn’t received anything. He’s divided his property amongst his sons from the second marriage. What can she do to get her rightful share?

Under Indian law, your mother can file a case for divorce and maintenance, even after so many years. She can also claim her share of her husband’s property, as she was legally married to him. The court will consider the duration of the marriage, the abuse she endured, and the financial contribution she made to the family while deciding her share.
