My marriage, spanning 15 years, has been difficult. From the start, my husband has constantly belittled me with harsh words. Over the past year, things have become unbearable. He stays home, drinks heavily, and causes a scene every night. He’s even started mistreating me and our children. He repeatedly demands I leave with our kids, claiming he has no property and therefore no alimony obligation. Could you advise me on my alimony rights in this situation?

Under Indian law, you are entitled to alimony even if your husband claims no property. The court considers factors like the duration of your marriage, your husband’s earning capacity, and his contribution to the breakdown of the marriage.
