My marriage of 8 years has been filled with mental and physical abuse. Last year, I even called the police twice, but my family convinced me not to file a formal complaint. Now, I’m back with my parents and want a divorce, but my husband refuses. We have a 7-year-old daughter. How can I get a divorce and ensure my daughter and I receive the maximum possible maintenance? I’m working – can I still claim maintenance?

You can file for divorce under the grounds of cruelty and desertion in an Indian court. As you have evidence of abuse and your husband’s refusal to separate, you can seek alimony and custody of your daughter. Your working status doesn’t preclude you from claiming maintenance, as the court considers your financial needs and the husband’s ability to pay.
