Under Indian law, a pending appeal does not automatically prevent a divorced person from remarrying. However, if the appeal successfully overturns the divorce decree, the subsequent marriage would be considered void under Section 11 of the Hindu Marriage Act. While bigamy charges are possible if the new marriage is proven to be knowingly entered into during a valid marriage, it’s a complex legal issue best addressed by consulting a lawyer.
