My husband has filed a case for restoration of conjugal rights (RCR) against me in the Jamtara court. He’s said in court documents that he wants me to live at his work place, but in court, he says he wants me to live at our matrimonial home, where he only stays a few days.
1. How can we be considered to be “restoring” our marriage if we live separately?
2. Does RCR mean I have to live with his parents against my will, even without my husband being there?
Best Answer
Under Indian law, restoration of conjugal rights aims to bring spouses together to attempt reconciliation. Living separately undermines this purpose. Living with your husband’s parents against your will solely because they are at the matrimonial home would not be a reasonable condition for RCR, especially if your husband himself is not present there regularly.
