My husband and I were married twice – once in an Arya Samaj ceremony and then in a Christian one, as I am Christian. We lived together for five years, but things didn’t work out. We got a mutual divorce in 2010, and the Arya Samaj marriage was formally dissolved. We didn’t officially acknowledge the second marriage anywhere. We continued living together after the divorce. Now, he doesn’t want to live with me anymore. Since we were divorced, am I still entitled to a settlement? Can I take any legal action in this situation?

As your Christian marriage was not officially acknowledged, it has no legal standing in India. Since your Arya Samaj marriage was dissolved through a formal divorce, you are not entitled to any legal settlement. However, you might be able to claim maintenance based on cohabitation if you can prove it and demonstrate financial dependence on your former husband during the period after your divorce.
