My husband and I moved to the US on student visas over 4 years ago. He’s been here for over 20 years. We got married in a Hindu temple in the US two years ago and registered it here too. We haven’t been back to India since. Sadly, my husband filed for divorce in the US last year, claiming our marriage is beyond repair. We’ve only been married for a year. Can I approach Indian family courts to stop this US divorce case, even though I’m still living in the US?
Best Answer
Indian family courts can only exercise jurisdiction over matrimonial matters if both parties are Indian citizens and the marriage was solemnized in India. Since your marriage was registered in the US and you are both residing there, it’s unlikely Indian courts would have jurisdiction in this case. You should consult with a legal professional to understand your options and the laws applicable in your situation.
