My husband and I have been married for 12 years. He’s always been violent, and I’ve been a victim of domestic violence. We have two children, an 11-year-old daughter and a 4-year-old son. I can’t leave them with my husband because of his violent nature. As a Hindu woman, can I get full custody of both my children and receive financial support to raise them?

Under Indian law, you can file for divorce on grounds of cruelty and seek sole custody of your children due to your husband’s violence. The court will consider the best interests of the children and likely grant you custody, along with maintenance for yourself and the children.
