My husband and I got married in May 2012, and our baby boy is just a month old. I’m a government employee currently on maternity leave. Since the baby’s arrival, my mother-in-law has been making my life difficult. She constantly finds fault with me and manipulates my husband against me. He, unfortunately, blindly follows her, believing her lies and creating unnecessary fights. She even tells him, right in front of me, to divorce me and remarry! I’m feeling helpless, especially since I have a tiny baby to care for. Adding to my woes, my husband and his mother constantly ask for money, despite my contribution to the family income. My husband even demands my entire salary without any accountability. For the last two weeks, I’ve been staying with my parents for peace of mind. If they decide to file for divorce, what legal options do I have? I don’t want to initiate divorce, but their constant threats and pressure are terrifying. They’ve even said I’ll lose my son and get nothing in a divorce. I’m incredibly scared and mentally exhausted. How can I protect myself and my child in this situation?

Under Indian law, you have several legal options to protect yourself and your child. You can file for a maintenance order against your husband and mother-in-law for your own support and the child’s upbringing. You can also seek a restraining order to prevent them from harassing or threatening you. Finally, you have the right to seek custody of your child, and the court will consider the child’s best interests in making this decision.
