My husband and I filed for divorce four months ago. We bought a row house in 2014, which is mortgaged with DHFL. I’ve been paying the EMIs and want the property solely in my name. I gave my husband ₹5 lakhs to release his claim on the house, which is mentioned in the divorce petition. However, he’s not giving me the necessary NOC from the society because he has outstanding dues. The society won’t issue the NOC to me because of these dues, as the house is jointly owned. Since I paid the agreed amount, how can I get the house registered under my name?

You can file a civil suit for specific performance against your husband to compel him to provide the NOC. The court can direct him to clear the outstanding dues and provide the NOC, enabling you to register the property in your name. You may also seek compensation for the delay caused by his actions.
