A simple agreement is not a legally recognized ground for divorce in India. The second marriage is likely valid if the divorce from the first marriage was obtained legally. Challenging the maintenance case requires specific grounds and evidence to demonstrate its unjust nature. Consulting a lawyer is strongly recommended for legal advice and further action.
