Your brother can file for divorce in India based on the marriage taking place there. Since he is in Dubai, he can file for divorce through a lawyer with Power of Attorney. He can seek a mutual consent divorce in India, even if his wife is not physically present, but a settlement agreement is recommended to avoid future maintenance claims.
