I’m working on a contract basis right now. My divorce case is still pending in court. If I get a full-time job and earn more than my husband, will I still have to pay child maintenance and alimony? He doesn’t keep proper records of his income, so there’s no proof of how much he actually earns. He even skips filing income tax returns. He’s also holding onto my jewelry and scooter, which are in my name, and refuses to give them back. What should I do?

In India, your income will be considered while determining child maintenance and alimony, but your husband’s earning capacity will also be assessed even if he doesn’t provide proof. You should seek legal advice to address the jewelry and scooter issue, as withholding property belonging to you is a legal offense.
