I’m planning to file for divorce in the USA and want to understand the legal implications in India. I’m considering using private processes for the Indian proceedings. If I change my address and phone number in the US, will my wife be unable to serve me with legal notices in India, delaying or stopping the case?
If that’s the case, can you explain how that would work?
My parents have their own property, and I have my own property from before and after marriage. If my wife files a case against me in India, could she claim any of this property? I have a 9-year-old son.
Also, if the case is filed in Nagpur Family Court, is video conferencing available for clients in the USA?
I’m hoping to get some clarity on these points before reaching out to an attorney for further consultation. Thank you for your time.

Changing your address and phone number in the USA could make it difficult to serve you with legal notices in India, but this would not necessarily stop the case. Your wife could still proceed with the divorce in India by using alternate methods to serve you, such as through your lawyer or by publication. Regarding property, your wife could potentially claim a share of your joint marital property acquired during your marriage, but not necessarily your individual assets from before or after the marriage. Video conferencing is available in the Nagpur Family Court, allowing you to participate in proceedings from the USA.
