I’m facing a difficult situation in my marriage. My husband has been abusive, both physically, verbally, and sexually. I’m only married for a year and am working. I want to seek a divorce, but I don’t have any proof of his abuse. What are my rights in this situation? What kind of alimony and maintenance can I expect? His family owns ancestral property, which is currently in his father’s name but will be inherited by him. What share can I claim in that property?

Under Indian law, you have grounds for divorce based on cruelty, which can include physical, verbal, and sexual abuse. You can seek alimony and maintenance, which can be decided based on your needs, his income, and the length of the marriage. You are not entitled to a share in the ancestral property unless it has been transferred to your husband’s name during the marriage.
