Under Section 125 of the CrPC, you are eligible for maintenance even if you are living with your husband. The court will consider your husband’s income, your needs, and the children’s needs to determine the amount. Your husband may try to challenge the maintenance order by showing that you have sufficient means of your own, but you can present your case and argue for a fair amount.
