In India, a wife cannot claim property based on false accusations of dowry harassment. However, she may be entitled to a share of marital property acquired during the marriage. The safest option for the husband would be to transfer the property to a parent or a trusted friend, as transferring to a sibling may be challenged in court. In a divorce, a wife can claim a share of marital assets based on various factors like contribution to the marriage, needs, and the duration of the marriage.
