I got married in February 2003 and have an 11-year-old daughter. Right from the start, my in-laws treated me poorly, making me feel like a servant. Realizing their behavior wouldn’t change, I moved back to my parents’ home in June 2013, where I live with my mother, brother, sister-in-law, and niece. My brother-in-law even filed a false complaint against me (354 CrPC) after I visited my matrimonial home with my daughter in November 2013. My father-in-law called me to collect some clothes, but it was a trap.
I’m not working and my brother is supporting us. I’m worried about my daughter’s future and want to secure her well-being. My in-laws own three properties. Is it possible for me to get a house and a fixed deposit of ₹25 lakhs in my daughter’s name? What are my options?

Under Indian law, you may be able to claim a share of your husband’s property, including a house and money, for your daughter’s welfare. You can file for divorce and seek alimony, maintenance, and custody of your daughter. You can also file for restitution of conjugal rights and claim a share of the property acquired during your marriage.
