Being a 35-year-old woman who converted from Catholicism to Islam and married a Muslim in Bandra court two years ago, I’m seeking guidance on getting a divorce. We had a customary marriage ceremony conducted by a court-appointed Kazi under Islamic law. My husband hasn’t lived with me for 18 months and has never provided financial support. I don’t want alimony and we don’t have children. Should I proceed with divorce even if my husband refuses to grant it?

Under Indian law, you can file for divorce based on your husband’s desertion for over two years, even if he refuses to grant it. Since your marriage was conducted under Islamic law, you can also seek dissolution based on his failure to provide financial support. You can file for divorce in a civil court in Mumbai.
