After separating from my husband in May, I filed for divorce and moved back to my parents’ home. We had a difficult time, and I even had to file a police complaint for physical abuse. Unfortunately, my husband refuses to give me any financial support, even for our daughter. He’s also holding onto some of our belongings, like my daughter’s schoolbooks and dance costumes, and my clothes. My lawyer suggests another police complaint, but my daughter is hesitant. Is there a way to get our things back without involving the police?

Under Indian law, you can file a civil suit seeking restitution of your belongings. You can also seek maintenance for yourself and your daughter through a separate legal process. However, your husband’s refusal to provide support may be grounds for a criminal complaint under the Domestic Violence Act.
