We got married in our hometown in Uttarakhand, both of us from the same city. We spent about two weeks there before moving to Nagpur. We visited our home twice in the first year and a half of our marriage. However, none of my family members came to visit us in Nagpur. In October 2014, my wife filed a police complaint against my entire family under Section 498A. The case was filed in court in June 2015. She also filed a separate criminal complaint against my family and my uncle in a Nagpur court in February 2015. The court has ordered an investigation into this private complaint. Is the Nagpur court the right place to hear this case?

Under Indian law, the Nagpur court may not be the appropriate forum for the case. The case should ideally be heard in Uttarakhand, your hometown, as that is where the marriage took place and where the alleged harassment occurred. The Nagpur court may transfer the case to Uttarakhand based on these factors.
