My wife filed a case against me under Section 498A and 406 of the IPC. I applied for anticipatory bail in the session court, but the hearing was postponed for 10 days because the police investigation officer hasn’t prepared the file yet. Should I approach the High Court? My wife has been living with her family for the past 8 months. Can I be arrested during this time? How can I avoid that?
Best Answer
You can approach the High Court for anticipatory bail if you believe the postponement is unreasonable. However, the High Court may not grant bail unless the police investigation is complete. You may still be arrested during this period, as the court can’t prevent the police from doing their duty. The best course of action is to cooperate with the police investigation and seek legal advice on your options.
