My father was charged with corruption during his government job. After retiring, he was found guilty and sentenced to 2 years in prison in April 2015. Based on Indian law, your father is unlikely to be eligible for back pension. The government generally stops pensions during periods of imprisonment for criminal offenses. Even with early release for good behavior, there’s no provision for retroactive pension payments for such cases.
