My brother’s wife’s brother has a Scheduled Caste certificate, though our family belongs to the Naicker caste, which isn’t listed in the Karnataka Gazette. He’s lived rent-free on our land for two decades, in a separate house on our compound. Now he’s claiming a share of the property. After we refused, he filed a caste-based humiliation case against my brothers at the local police station. We’re unable to evict him as there’s no rental agreement.

Your brother’s wife’s brother’s caste status is irrelevant to his right to claim a share of the property. His claim must be based on a valid legal basis, such as inheritance or a written agreement. Since there’s no rental agreement, and he’s lived on the land for 20 years, a court may consider adverse possession. The caste-based humiliation case is a separate issue that needs to be addressed independently.
