My 498A case was dismissed by the High Court in December 2012. They didn’t appeal to the Supreme Court, but in October 2013, my brother’s family filed a civil defamation case against me. Now, my brother’s wife wants to re-open the case in the same High Court.
I have a few questions:
1. Is it even possible to re-open the case in the same High Court?
2. Can I take this matter to the Supreme Court?
3. I received a notice about this re-opening. What should I do? This whole process is causing a lot of stress to my family.
It is highly unlikely the High Court will re-open the 498A case after dismissal. However, you can file a caveat in the High Court to be heard before any proceedings are initiated. Regarding the defamation case, you can challenge it in the Supreme Court, but the High Court’s decision on the 498A case would be binding.
