I filed a case in court under Section 156(3) CrPC because the police refused to register my FIR. The court ordered the police to submit an ATR. They investigated but submitted a false report. Will the magistrate judge based solely on the ATR, or will I be given a chance to question the points mentioned in the ATR? Will there be cross-examination between the police and me in front of the magistrate at the next hearing? Or will the magistrate simply dismiss the case after reviewing the ATR without giving me a chance to speak?

The magistrate will not solely rely on the ATR. You will have the opportunity to question the points mentioned in the ATR and present your evidence. The magistrate will then decide based on the evidence presented by both parties, including your testimony and cross-examination of the police.
