I’ve been working at this Kerala-based company since May 2015 and resigned on July 8th, 2016, with immediate release by July 12th. The company is facing financial trouble and hasn’t paid salaries for the past five months. My appointment letter says I need to serve a three-month notice period or pay in lieu. I asked the company to deduct the notice period from my dues, but they’re not paying my salary or giving me a relieving letter. My new employer wants a relieving letter and wants me to join right away. What should I do?

You are entitled to receive your pending salaries for the past five months, including any notice period pay. The company’s financial difficulties do not excuse them from paying your dues. You can approach the Labour Commissioner in Kerala and file a complaint for non-payment of wages and for the issuance of a relieving letter.
