What happens to a trademark if its owner passes away without a will? Let’s say the owner has a son with a special power of attorney for using the brand. Can the son inherit the trademark, even without an official transfer?

In India, a trademark is considered an asset and passes to the legal heirs as per the Indian Succession Act, 1925. While a special power of attorney grants rights to use the trademark, it doesn’t automatically transfer ownership. The son would need to formally inherit the trademark through legal succession proceedings.
