We’ve written a novel together, and we came up with the title “Love Therapy – Ordinary Yet Bizarre.” However, we found that “Love Therapy” is already registered (like this one: [link to website]). Our publisher hasn’t said anything about this yet. Do we need to change the title? Or can we still use it, even though it’s already registered? If we can use it, do we need to get copyright for the entire title, including the subtitle?

Under Indian law, you cannot use a title already registered as a trademark for your novel without the trademark owner’s permission. While you can use “Love Therapy – Ordinary Yet Bizarre,” you may need to modify the “Love Therapy” portion to avoid trademark infringement. You do not need to register the entire title, including the subtitle, for copyright protection; the entire work is automatically copyrighted once it’s created.
