We recently purchased a top-floor apartment in a well-regarded society in Delhi. We were assured that the mobile tower would be removed after a residents’ meeting decision. However, despite a 9-year contract with no termination clause, the RWA has now installed 3G, digital TV, and Wi-Fi on the existing tower. Our building is over 20 years old, with existing cracks and seepage. Now, my newly renovated flat has also developed cracks. What legal action can I take to get this tower removed?

You can file a complaint with the Delhi Pollution Control Committee (DPCC) citing health hazards due to electromagnetic radiation and potential structural damage. Additionally, you can sue the RWA for breach of contract and negligence, seeking compensation for the damage to your flat. You may also explore the possibility of challenging the installation on grounds of violating building bylaws or environmental regulations.
