We booked a new villa under construction last year, paying an initial amount. We canceled the booking after a few weeks, as the area flooded during last year’s heavy rains. It’s been a year since we’ve been requesting a refund, but haven’t received any response.

Under Indian law, you are entitled to a refund if the builder failed to disclose the flooding risk, which rendered the property unfit for its intended use. Since you canceled within a reasonable time and the builder hasn’t responded, you can pursue legal action to recover your initial payment.
