We are a group of 75 buyers, all part of a registered association, who purchased flats in a new building in Navi Mumbai. Our purchases were made between 2011 and 2014, each with a different promised possession date, as per our registered sale agreements. My agreement states a June 2014 possession, while the latest agreement has a December 2015 date. However, none of us have received our flats yet.

Under Indian law, the builder’s failure to deliver possession by the promised date constitutes a breach of contract. You can, as an association, collectively initiate legal action against the builder to seek compensation for delayed possession and seek court-ordered possession of your flats.
