Our building is in dire straits and the developer is refusing to honor the original agreement, instead pushing for terms that benefit them. We’ve tried to reason with them, but they’re not budging. Even worse, our own appointed lawyer and project consultant seem to be working against us. The majority of our 12 members want to take this to court and hold the developer, lawyer, and consultant accountable. Should we go ahead with this, and what kind of costs should we expect?

Based on Indian law, you have the right to pursue legal action against the developer, lawyer, and consultant for breach of contract and professional misconduct. Expect significant legal costs including court fees, lawyer fees, and expert witness fees. It’s advisable to consult with a different lawyer experienced in construction and real estate disputes to assess the merits of your case and potential costs.
