My flat at Amrapali Silicon City in Noida was booked on April 14th, 2011, with a promised possession date of September 2013, within 2 years of booking. The agreement includes a penalty of Rs. 10 per square foot per month for delays beyond the promised date. I made the final payment on October 1st, 2014, but still haven’t received possession or any penalty for the delay. Should I consider approaching the consumer court? If so, who can help me navigate this process?

Yes, you can approach the consumer court as the builder has breached the agreement by not delivering the flat on time and failing to pay the agreed penalty. You can consult a lawyer specializing in real estate and consumer law to navigate the process of filing a complaint and representing you in court.
