I booked a flat in a pre-launch project in June 2016 and paid a booking amount of ₹6 lakhs through bank transfer. I received receipts with details like price, area, and address. The builder promised to start construction by September, but there’s been no progress and I haven’t received any updates. I’ve requested a refund, but the builder is refusing. We didn’t have a formal agreement, just my payment and the receipts. I’m currently overseas. How can I get my booking amount back?

You can file a complaint with the Real Estate Regulatory Authority (RERA) as your project falls under its purview. You can also file a civil suit for refund in a court of competent jurisdiction, based on the receipts and payment evidence, seeking a refund and compensation for the delay. You can engage a lawyer in India to represent you and handle these proceedings.
