I booked a flat and paid an advance by cheque. Now I’ve learned the building has a bank mortgage and the builder is in default. I want my advance back, but he’s avoiding me and says he’ll refund when the flat is booked. What should I do?

You can file a legal complaint against the builder for breach of contract and seek a refund of the advance. The bank’s mortgage doesn’t affect your right to a refund, as it’s a separate issue. You can also approach the Consumer Forum for redressal.
