Five years ago, while serving as Treasurer of our Apartment Association, our cashier misappropriated ₹50,000. He confessed to the wrongdoing. The Association’s General Body decided to file a police complaint to recover the funds. A complaint was filed, but the money was not recovered. Now, the current office bearers have passed a resolution demanding that I, the Treasurer at that time, reimburse the Association. Is this resolution legally valid? What are my options?
Best Answer
The resolution demanding reimbursement from you is likely invalid as you were not directly involved in the misappropriation. You can contest this resolution and seek legal advice to protect your interests. You can also approach the association and explain your situation, emphasizing your lack of involvement in the theft.
