Can my society prevent me from building a toilet in my shop?
I own a shop within my society’s premises, having paid all their dues and obtained a no-objection certificate before buying it. I want to open a clinic, which needs a toilet. Can the society stop me from creating a toilet within my shop? Alternatively, can they prevent me from using the common society toilet already being used by security personnel? They claim they won’t allow me to use the existing drainage system.

Your society cannot prevent you from building a toilet within your shop as long as it meets local building regulations and does not infringe on any other common areas or property rights. They also cannot restrict your access to the existing society toilet, especially if it is already being used by others, unless there are specific clauses in your agreement or by-laws prohibiting it. Consult a lawyer if you face further obstruction.
