My Maruti Ritz was parked in a Jammu Development Authority parking lot, where I pay a monthly fee of Rs. 1,500. On the night of December 30th, my windshield was shattered by a falling tree. The parking staff claimed it was caused by monkeys shaking the tree. I filed a police report, but my car insurance had unfortunately expired on December 25th. Since the parking authority was responsible for my vehicle’s safety, could I be entitled to some compensation for the damages? I’d appreciate a legal opinion on this matter.

In this case, the parking authority had a duty to ensure your vehicle’s safety. While the cause of the damage was an act of nature, the parking authority’s failure to maintain the safety of the parking lot could be considered negligence.
