You can argue that your lawyer’s negligence and repeated misrepresentations about the claim’s status caused the delay. This prevented you from filing the claim yourself within the time limit, leading to its dismissal. You should provide evidence of your lawyer’s promises and inaction, as well as the prejudice you suffered due to the missed deadline.
