My lawyer promised to file an insurance claim for me, but he kept delaying and saying it was “in process”. Sadly, I found out he never filed it at all and the claim was dismissed because it was too late. I finally filed the case myself after almost three years, and the court wants a good reason for the delay. How can I build a strong argument to get my case accepted?

You can argue that your lawyer’s negligence and repeated misrepresentations about the claim’s status caused the delay. This prevented you from filing the claim yourself within the time limit, leading to its dismissal. You should provide evidence of your lawyer’s promises and inaction, as well as the prejudice you suffered due to the missed deadline.
