I got married in 2005 and bought a flat jointly with my wife on August 24th, 2008. I’m still paying off the bank loan on the flat. My wife left the house in 2014 and filed for divorce in a Mumbai family court. She also filed a domestic violence case against me. The divorce was granted on September 1st, 2014, and the domestic violence case was dismissed on December 22nd, 2014. Now, I want to remove my wife’s name from the house ownership. What should I do?

Since the flat was purchased jointly during your marriage, your wife has a legal stake in it. To remove her name, you’ll need to file a partition suit in a civil court. The court will consider the contributions of both parties and the circumstances of your separation, including the domestic violence case, to decide on a fair division of the property.
