I booked a resale flat and paid a booking amount of Rs. 2 lakhs by cheque. Due to unforeseen financial difficulties, I had to cancel the deal and requested a refund. The seller initially offered only Rs. 1 lakh. After filing a complaint with the police, he agreed to repay the full amount by February 16th. He gave me two cheques of Rs. 50,000 each, dated April 16th and May 16th, but both bounced in June 5th. Unfortunately, I was hospitalized for 1.5 months due to illness. Upon my return, the seller gave me another cheque for Rs. 25,000, which also bounced on September 14th.

Under Indian law, you have grounds to file a legal case against the seller for breach of contract and dishonoring cheques. You can seek recovery of the remaining Rs. 1.25 lakhs along with interest and compensation for the bounced cheques. The case can be filed in a consumer forum or a civil court, depending on the value of the claim.
