While the Supreme Court has ruled in favor of existing owners, it’s not a blanket permission to construct. The BBMP’s refusal to grant permission based on their current policies means you cannot legally start construction without approval. Building without permission can lead to legal action and demolition, and an injunction may not be granted in your case. You should consult with a lawyer specializing in real estate law to understand your options and navigate the legal process.
