Hi,
I own a house in Bangalore. I got BBMP approval in 2009 to build two floors, but I only constructed the ground floor. Now I want to build the remaining two floors. However, the BBMP isn’t issuing new approvals. The Supreme Court has ruled in favor of existing owners, but the BBMP still isn’t granting permission.
Can I start construction without the approval and get an injunction if someone tries to stop me?
Thanks for your advice.

While the Supreme Court has ruled in favor of existing owners, it’s not a blanket permission to construct. The BBMP’s refusal to grant permission based on their current policies means you cannot legally start construction without approval. Building without permission can lead to legal action and demolition, and an injunction may not be granted in your case. You should consult with a lawyer specializing in real estate law to understand your options and navigate the legal process.
