My wife left me after a small argument just before our baby was due. We went through a lot of tension with her family, but things seemed to settle down during the delivery. However, she refused to come home with the baby. It’s been almost half a year and nothing I do seems to work. She’s also blocking me from seeing our child. What legal options do I have? If she files for divorce, are my chances of getting custody of our child good?

You can file a petition for custody of your child and seek access to your child. While Indian courts generally favor the mother’s custody, the court will consider the child’s welfare and your active involvement in the child’s life. Your chances of obtaining custody will depend on your circumstances, your willingness to provide for the child, and your ability to demonstrate that your wife is unfit to care for the child.
