My wife filed a false 498A case against me in Noida, four months ago. We’ve been married for six happy years and have two sons, who will turn five and three in a couple of months. I’m worried about my children. I’ve heard that in Uttar Pradesh, mothers usually get custody until the kids turn seven. What are my chances of getting them back?

In India, the court considers the best interests of the child as paramount. While a mother often gets custody until the children turn 7, it is not a fixed rule. You can file for custody, presenting evidence of your loving relationship with your children and the false nature of the 498A case, to argue for shared or sole custody.
