My wife and I, both from different faiths, got married in 2003 and had a church blessing in 2011. We have a 2-year-old son who is currently staying with my wife at her aunt’s place. I left her there in anger, and now she refuses to come back. We lived in our own home, separate from my parents. Now she says she doesn’t love me anymore and wants to separate without going to court. She also wants to keep our son and convert him to her faith. All of this is happening because of her mother’s interference. Her mother lives in a rented house near our home and my wife stayed there for the entire day during our marriage for the past three years. What can I do to get my son back?

In India, a child’s custody is determined based on the child’s welfare. You can file a custody petition in court, presenting evidence of your son’s well-being and your ability to care for him. You can also seek legal counsel to address your wife’s claims of separation and religious conversion of your son, which are subject to legal scrutiny.
