A 16-year-old boy living in Dehradun was informally adopted by his uncle in 2005, when he was just 6 years old after being abandoned by his mother. There were no formal papers, just a simple act of taking him in. His uncle later married in 2008 and moved to England, leaving the boy in the care of his grandparents. Now, the adoptive father wants to formally adopt the boy and take him to England. Is it possible to create a legal adoption document now?

Formal adoption for a minor in India requires court approval and adherence to the Juvenile Justice Act, 2015. While informal adoption is not recognized legally, the boy’s long-standing relationship with his uncle and the absence of his biological parents might strengthen the case for formal adoption. The court will consider all aspects, including the boy’s welfare and his willingness to move to England, before making a decision.
