Our small business is currently under the Board of Industrial and Financial Reconstruction (BIFR). We issued some checks to a few individuals which unfortunately bounced, leading to them filing a case against us. Can we seek relief from the High Court considering our situation under BIFR?
Best Answer
Yes, you can seek relief from the High Court under Section 22(4) of the Sick Industrial Companies (Special Provisions) Act, 1985, which allows for the stay of proceedings against a company under BIFR. The Court will consider the company’s situation under BIFR and the nature of the claim while deciding on the relief.
