Namaskar sir, A person owes us around 70,000 rupees. He gave cheques in my husband’s name, but they bounced three months ago. We spoke to him and he promised to settle soon, but he hasn’t. I only have one cheque left in my husband’s name, and he is out of the country. Should I bounce this cheque and file a case in his name?

It is generally advisable to avoid bouncing a cheque intentionally, as it can lead to criminal charges under Section 138 of the Negotiable Instruments Act. Instead, you can pursue legal action by filing a complaint with the appropriate court, even without the last cheque. You can also consider sending a legal notice to the debtor demanding payment, which may encourage them to settle the outstanding amount.
