Under Indian law, a post-dated cheque can be legally presented for payment only after the date mentioned on it. Since your father passed away, the cheque is no longer valid. Your mother and you are not obligated to pay the amount, and you can legally challenge the demand. It is advisable to consult a lawyer to understand your options and proceed accordingly.
